Walk 62 Miles in October

These Terms and Conditions (“the Terms”) apply to the Walk 62 Miles in October challenge (the “Challenge”).  By registering for the Challenge you are agreeing to comply with the Terms, and confirm that you satisfy the age requirements set out below. Please check this page from time to time, as we may occasionally amend the Terms and any changes will be binding on all Challenge participants.

The Brooke Hospital for Animals (a company registered in England and Wales under no.  4119581 and a charity registered under no. 1085760) and with its registered office at 66 Lincoln's Inn Fields, London, WC2A 3LH is organising the Challenge.

1.    All participants must abide by the Terms and any additional guidance that we may give from time to time.  Please check back on our website for any updates. 
2.    Participants who are under the age of 16 should be registered for the Challenge by their parent or legal guardian, and an adult who is aged 18 or over should accompany them during the Challenge. 
3.    Participants agree to take responsibility for their own health, safety, and fitness when taking part in the Challenge. Any participant unsure of their physical ability to take part in the Challenge must seek medical advice prior to taking part in the Challenge.  
4.    Participants acknowledge that by its nature Brooke will be unable to supervise the Challenge and acknowledge that there may be risks associated with the Challenge.  All participants enter and undertake this Challenge entirely at their own risk. 
5.    Brooke shall not be liable for any injury or loss to persons or their property that might occur because of participation in the Challenge. For the avoidance of doubt, nothing in this clause shall limit our liability for any other liability that cannot be restricted or excluded by law. 
6.    We ask each participant to fundraise a minimum of £150 to Brooke.  When you register you will receive all the information you need to start fundraising.
7.    Any monies raised in connection with the Challenge are held on trust for Brooke, and therefore all participants have a legal responsibility to ensure that all donations and sponsorship monies raised in connection with the Challenge are paid to Brooke promptly. 
8.    All monies raised in connection with the Challenge will be distributed across all of Brooke’s work where the need is greatest, helping working horses, donkeys and mules.
9.    Brooke may offer free items or fundraising incentives as part of an event. These items are subject to availability and are not guaranteed. Brooke reserves the right to withdraw or substitute any item at its discretion.
10.    Where fundraising incentives are offered, these will be fulfilled only once the required fundraising threshold has been met and verified by Brooke.
11.    By providing personal data when you register for the Challenge, you confirm that you consent to such data being used by us and any relevant third parties for the purposes of organising, staging and administering the Challenge. If you provide personal data on behalf of additional entrants, you also confirm that you have obtained their consent for such data to be used for the same purposes. 
12.    Your personal information will be used for communicating with you in connection with the Challenge.  It may also be used for the purposes of sending communications to you where you have confirmed that you would like to receive further information about the charity’s work when registering for the Challenge.  If you would prefer not to hear from us, and have not already told us this when you entered, you can please contact our supporter care team on 020 3012 3456 or email [email protected] to let us know. 
13.    All personal data held by us will be handled in accordance with the terms of the Data Protection Act 2018 and in accordance with Brooke’s privacy statement which can be found at this link. 
14.    By taking part in the Challenge participants confirm that they are happy for their names and any video footage, stills or photographs taken of them participating in the Challenge which may be sent to Brooke to publicise the Challenge and future similar challenges by Brooke to publicise the Challenge and its work and for fundraising purposes including, but not limited to, placing those materials on Brooke’s website, social media, television broadcasts, advertising, publications, marketing material and personalised direct mail and other documents that may be made available to the public.  
15.    No personal details (including names or photographs) of anyone under the age of 16 will be used in the manner described above without the written consent of that child’s parent or legal guardian. 
16.    Subject to rule 2 above, by registering a participant under the age of 16 you confirm that you or the participant’s parent/legal guardian (as applicable) are happy for their images to be used in the manner described in these Terms.
17.    Participants or their guardians may withdraw consent for the use of their images or videos at any time by contacting Brooke’s supporter care team in writing. Upon receipt of such notice, Brooke will cease using the relevant images or footage, subject to legal or contractual obligations.
18.    Brooke reserves the right to cancel or reschedule the Challenge at any time due to unforeseen circumstances, including but not limited to safety concerns, legal or regulatory requirements, or force majeure. In such cases, Brooke will notify participants as soon as reasonably practicable. Refunds or alternative arrangements will be handled at Brooke’s discretion, and Brooke shall not be liable for any costs incurred by participants due to cancellation or postponement.
19.    In the event that the Challenge is cancelled or postponed, Brooke will make reasonable efforts to communicate with participants regarding the disposition of any funds raised. All funds already received will be held in trust for Brooke and will be used in accordance with Brooke’s charitable purposes, unless participants are otherwise notified. Brooke shall not be liable for any costs or losses incurred by participants due to event cancellation.
20.    Brooke may also require any participant to withdraw from the Challenge where it reasonably considers that continued participation may present a risk to the participant, others, or Brooke's reputation, or where a participant has breached these Terms. If we ask you to withdraw from the Challenge, you shall have no continuing right to use Brooke's name, branding or any materials provided in connection with the Challenge.
21.    Governing Law and Jurisdiction: This agreement shall be governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
